LIABILITY WAIVER AND RELEASE AGREEMENT Motorcycle riding is dangerous IMPORTANT NOTICE: This is a legal document that affects your rights. By signing this Agreement, you acknowledge that you have read and understood its terms and agree to be bound by them. If you do not understand any part of this Agreement, seek legal advice before signing. 1. Acknowledgment of Risks 1.1. I understand and acknowledge that participation in the Recreational Activity of riding a sidecar and motorcycle (the "Recreational Activity") provided by RentmeRV Pty Ltd trading as SidecarRides ("the Provider") involves significant risks. These risks include but are not limited to, the risk of serious injury, physical harm, or death. 1.2. I accept and assume all risks associated with participating in the Recreational Activity, whether caused by my actions or the actions, omissions, or negligence of the Provider, its officers, employees, agents, volunteers, or representatives. 2. Voluntary Participation 2.1. I confirm that my participation in the Recreational Activity is entirely voluntary. 2.2. I declare that I have not been pressured, coerced, or unduly influenced to sign this Agreement and that I am aware of my right to choose not to participate. 3. Release of Liability 3.1. To the extent permitted by law, I release, discharge, and hold harmless the Provider, its directors, officers, employees, agents, and volunteers (collectively, the "Released Parties") from any and all claims, actions, suits, or proceedings of any kind arising from personal injury, illness, death, or property damage sustained by me during or in connection with my participation in the Recreational Activity, including claims arising from the negligence of the Released Parties. 4. Indemnity 4.1. I agree to indemnify and keep indemnified the Released Parties from and against any claims, actions, suits, or liabilities of any kind brought by any third party as a result of my participation in the Recreational Activity. 5. Waiver of Certain Rights 5.1. I agree that the liability of the Provider for any personal injury suffered by me as a result of the supply of Recreational Services is excluded to the extent permitted under Section 139A of the Competition and Consumer Act 2010 (Cth) or any equivalent state or territory legislation. 5.2. I understand that in the event of injury, I will rely solely on Transport Accident Commission (TAC) or equivalent insurance for treatment and support services related to transport accidents. 6. Protective Equipment and Rules 6.1. I agree to wear appropriate protective clothing and equipment at all times during the Recreational Activity. 6.2. I agree to comply with all rules, instructions, and safety protocols provided by the Provider or its representatives. 7. Parent/Guardian Declaration (if Participant is a Minor) 7.1. In my capacity as the parent/guardian of the Participant (the "Participant"), I make all acknowledgments, releases, and agreements set out in this Agreement on behalf of the Participant, as if I were the Participant. 7.2. I warrant that: I have fully explained to the Participant that the Recreational Activity involves significant risks of injury, physical harm, or death; and I will ensure that the Participant complies with all rules and instructions given by the Provider. 8. Potographs before, during, and after the ride I agree to photographs and videos taken of me as the participant before, during and after the ride to be shared with me and on the website and social media networks of Sidecarrides and other partners I have read this Agreement and fully understand its terms. I acknowledge that by signing this document, I am waiving certain legal rights, including the right to sue the Released Parties. I sign this Agreement voluntarily and without inducement.
